You won't have much trouble making a helmet that meets DOT standards. The Dot allows a manufacturer to put the DOT sticker on a helmet as long as the manufacturer believes the helmet will p the required safety tests. So you could make a helmet out of cardboard, say "I believe" and slap on the sticker.
